By accessing or using TheWChat (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms.
If you do not agree to these Terms, you may not access or use the Service.
TheWChat is a multi-tenant, enterprise-grade team communication platform that provides instant messaging, audio/video calling, file sharing, screen sharing, and group collaboration features. The Service is offered through web-based access and may include additional interfaces in the future.
Each organization operates within its own isolated workspace. The workspace administrator ("Admin") is responsible for:
Free Trial: New workspaces receive a 15-day free trial. No credit card is required. At the end of the trial, your workspace will be deactivated unless you subscribe to a paid plan.
Paid Plans: Subscriptions are billed monthly or annually as selected. Prices are listed on our Pricing page.
Cancellation: You may cancel your subscription at any time. Access continues until the end of the current billing period. No refunds for partial periods unless within our 30-day money-back guarantee.
Plan Changes: You may upgrade or downgrade your plan at any time. Upgrades take effect immediately; downgrades take effect at the next billing cycle.
You agree not to use the Service to:
We reserve the right to suspend or terminate accounts that violate these terms.
Your Data: You retain all ownership rights to the content and data you upload to TheWChat. We do not claim ownership of your messages, files, or any other content.
License to Operate: You grant us a limited license to host, store, and transmit your content solely for the purpose of providing the Service. This license terminates when you delete your content or close your account.
Our Content: The TheWChat platform, including its design, code, features, and branding, is our intellectual property and is protected by copyright and trademark laws.
We strive to maintain 99.9% uptime. However, the Service may be temporarily unavailable due to scheduled maintenance, upgrades, or circumstances beyond our control. We will provide reasonable notice for planned downtime when possible.
To the maximum extent permitted by law, TheWChat shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.
Our total liability for any claims arising under these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim.
You agree to indemnify and hold harmless TheWChat, its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
We may terminate or suspend your access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.
Upon termination, your right to use the Service ceases immediately. Data export may be requested within 30 days of termination.
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or an in-app notification at least 30 days before they take effect. Continued use of the Service after changes become effective constitutes acceptance.
These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Mumbai, Maharashtra.
